1Introduction and Acceptance
Welcome to DocuGap, a document comparison and analysis platform operated by RegAffinity GmbH ("RegAffinity," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our web application, mobile application, and SaaS platform (collectively, the "Service").
Important: By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
Please note: This Service integrates artificial intelligence (AI) technology. Whenever you receive explanations, categorizations, or analytical outputs through the Service, these are generated in whole or in part by an AI system.
2Service Description
RegAffinity GmbH provides an AI-powered document comparison and change categorization. The part of the service that is performed by AI is the categorization.

Intended Purpose
The AI components of the Service are designed solely to support document comparison and regulatory analysis. They are not intended to replace professional legal, regulatory, or compliance judgment and must not be relied upon as the sole basis for business or compliance decisions.
Intended Purpose under the AI Act Regulation (EU) 2024/1689
This system is intended for document comparison and regulatory analysis support, not for automated compliance decisions. The system does not guarantee legal or regulatory compliance and must not be used as the sole basis for such decisions. The user must apply appropriate human review and oversight before acting on AI outputs.

Prohibited Uses
By using our products you agree not to use the AI system for any activities that are prohibited under applicable laws, including but not limited to the EU AI Act. In particular, you must not use the system for:
- •Unlawful surveillance or monitoring of individuals, including biometric or facial recognition in public spaces for law enforcement purposes, unless expressly permitted by law.
- •Exploiting vulnerabilities of individuals or groups based on age, disability, or socio-economic status.
- •Social scoring of individuals by public or private entities leading to discriminatory or detrimental treatment.
- •Any form of discriminatory analysis or profiling based on race, ethnicity, political opinions, religion, sexual orientation, health status, or other protected characteristics.
- •Manipulative, deceptive, or exploitative practices that may cause harm to individuals' rights, safety, or dignity.
Any violation of these restrictions will result in immediate suspension or termination of access to the system, without prejudice to any other legal remedies.
Note: The Service integrates third-party tools, to enhance document comparison capabilities.
3User Accounts and Registration
3.1Account Creation
To use the Service, you must create an account by providing accurate and complete information, including contact details required for login purposes.
3.2Account Security
You are responsible for:

You agree to keep your account information current and accurate. We collect only essential user data including login credentials and contact information necessary for service provision.
4Subscription and Payment Terms
4.1 Subscription Model
The Service operates on a paid subscription basis. Current subscription plans, pricing, and billing cycles are available on our website.
4.2 Payment
- Subscription fees are charged in advance on a recurring basis
- All fees are non-refundable unless otherwise specified
- You authorize us to charge your designated payment method
- In-app purchases may be available for additional features or services
4.3 Price Changes
We may modify subscription prices with thirty (30) days' advance notice. Price changes will not affect your current billing cycle.
4.4 Suspension for Non-Payment
We may suspend or terminate your access to the Service if payment is not received within thirty (30) days of the due date.
5User Obligations and Acceptable Use
5.1 Document Upload
You may upload documents for comparison and analysis. You represent and warrant that:
- You have the right to upload and analyze the documents
- The documents do not contain illegal, harmful, or infringing content
- You comply with all applicable laws regarding the documents you upload
5.2 Prohibited Uses
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse engineer, hack, or interfere with the Service
- Upload malicious code, viruses, or harmful content
- Share your account credentials with others
- Use the Service to violate any third-party rights (including copyrights)
You further agree not to use the AI system for any prohibited purposes as defined under the EU AI Act (Regulation (EU) 2024/1689), including but not limited to unlawful surveillance, discriminatory profiling, or uses that may infringe on fundamental rights.
Human Oversight Required: Users must apply appropriate human oversight when using AI-generated results and remain responsible for reviewing, verifying, and validating outputs before relying on them in any professional or regulatory context.
6Data Protection and Privacy
We are committed to compliance with the General Data Protection Regulation (GDPR) and other applicable data protection laws. We collect only necessary personal data and process your uploaded documents solely for providing our service. Detailed information about our data practices is available in our Privacy Policy.
In line with the EU AI Act, we are committed to ensuring that the development and use of AI systems respects fundamental rights. Users may raise concerns or complaints regarding AI-related risks or impacts via the contact channels provided in our Privacy Policy.
7Intellectual Property
RegAffinity GmbH retains all rights in the Service, while you retain ownership of documents you upload. AI-generated analysis is provided as a tool and should be validated before use in business or regulatory contexts.
8AI and Third-Party Services
Our Service utilizes AI and integrates with third-party tools like Draftable. AI-generated results are for informational purposes and should be reviewed by qualified professionals. We do not guarantee the completeness or accuracy of AI analysis.
Limitations: Users should be aware that AI analysis may be incomplete, contain errors, or reflect limitations of the training data and algorithms used. The Service does not guarantee legal or regulatory compliance.
9Disclaimers and Limitation of Liability

We are not liable for the output, analysis, categorizations, or explanations provided by our AI system. Users must always review, verify, and validate all AI-generated content before applying it to their business, regulatory compliance, or decision-making processes.
Compliance Statement: The Service is operated in accordance with the EU AI Act. At present, the Service is not classified as high-risk under Annex III of the Regulation. If the classification changes in the future, these Terms will be updated to reflect conformity assessment, CE marking, and related obligations.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.
10Term and Termination
These Terms remain in effect while you use the Service. Either party may terminate as specified in the full terms.
11Governing Law and Jurisdiction
These Terms are governed by Swiss law. Disputes are subject to the jurisdiction of courts in Zürich, Switzerland.
12General Provisions
These Terms, together with our Privacy Policy, constitute the entire agreement. We may modify these Terms with notice.
